By accessing and using Aphora ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Aphora provides a photo sharing and screensaver service that allows users to upload, organize, and display photos on Roku devices. The Service includes a Premium subscription with a free trial period.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information when creating your account
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
4. Content Ownership and Rights
You retain all rights to the photos and content you upload to Aphora. By uploading content, you grant Aphora a limited license to store, process, and display your content solely for the purpose of providing the Service.
You are responsible for ensuring you have the right to upload and share all content you post to the Service. You must not upload content that:
- Violates any copyright, trademark, or other intellectual property rights
- Contains illegal, harmful, or offensive material
- Violates the privacy or publicity rights of others
- Contains malware or malicious code
5. Subscription, Trial, and Payment
Aphora offers a Premium subscription plan with a 14-day free trial. The free trial provides full access to all Premium features. After the trial period ends, you must subscribe to continue using Premium features.
Paid subscriptions are billed on an annual basis and will automatically renew unless cancelled. You agree to:
- Provide accurate and complete payment information
- Pay all fees associated with your subscription
- Accept that fees are non-refundable except as required by law
We reserve the right to change our pricing and subscription plans at any time, with notice to existing subscribers.
6. Service Limitations and Fair Use
Premium subscribers have access to unlimited photo uploads, subject to fair use policies. The Service is designed for personal and family use, specifically for sharing photos to be displayed on Roku screensavers.
To ensure a quality experience for all users, we maintain reasonable limits on storage and usage:
- Photos should be personal or family photos intended for screensaver display
- Excessive storage usage beyond typical family photo sharing may be subject to review
- Commercial use, bulk storage, or use as a general file hosting service is not permitted
- We reserve the right to contact users whose usage significantly exceeds normal patterns
When a trial or subscription expires, your photos remain safely stored, but you will not be able to upload new photos, pair new devices, or create new share links until you subscribe.
7. Prohibited Uses
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers
- Use the Service for commercial purposes without authorization
- Use the Service as a general file storage or backup service
8. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms of Service or for any other reason we deem necessary to protect the Service or other users. You may cancel your account at any time through your account settings.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
10. Limitation of Liability
To the fullest extent permitted by law, Aphora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.
